Terms of Service

These Terms of Service ("Terms") govern your access to and use of the StyleWizard website and application at thestylewizard.com (the "Service"). The Service is operated by UPVIS Kevin Schwed, Neckaring 99, 64521 Groß-Gerau, Germany ("we", "us"). By using the Service you agree to these Terms.

1. What the Service does

StyleWizard is an AI-powered styling tool. The typical flow is:

• You upload a photo of yourself and choose an occasion and style preferences.
• We send the photo and your inputs to Google's Gemini API, which generates a restyled image of you on a clean studio-style background.
• We generate a personal style guide with structured recommendations (e.g. tops, bottoms, shoes, colors, fit tips) and compose a shareable guide card.
• The results are saved to your personal library. Your original uploaded photo is processed transiently and is not stored (see our Privacy Policy).
• Where available, "Shop the Look" may link you to third-party retailers via affiliate links.

All outputs are non-binding styling suggestions generated by AI. They are not professional styling, medical, or any other form of advice.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a contract. The Service may not be used by or on behalf of minors.

3. Account & sign-in

You sign in using your Google account. You are responsible for keeping access to your account secure and for activity that occurs under it. We process your Google profile data as described in the Privacy Policy.

4. Credits & prices

• The Service runs on credits; each generation consumes credits.
• New accounts receive a number of free starter credits.
• Additional credits are available as one-time packs or through a membership. Current packs and prices are shown in your account.
• All prices are shown in US dollars (USD). Any applicable taxes (such as VAT) are calculated and displayed at checkout.
• Purchased credits do not expire.

5. Membership (Style Club)

A membership is a subscription that renews automatically each month and grants a monthly allotment of credits plus perks. It is billed in advance via Stripe. You can cancel at any time with effect from the end of the current billing period via your account / the customer portal. Already granted monthly credits remain available per Section 4.

6. Payment & billing

Payments are processed by Stripe Payments Europe. By purchasing you authorize us (via Stripe) to charge the applicable amount. For subscriptions, you authorize recurring charges until you cancel. Invoices / receipts are made available by Stripe and/or in your account.

7. Right of withdrawal for digital content

For paid digital content and services (credits, generations, membership): by starting a generation or otherwise requesting immediate provision of the service, you expressly consent to us beginning performance before the end of the statutory withdrawal period, and you acknowledge that you thereby lose your right of withdrawal in respect of fully performed digital content (§ 356(5) BGB). For any not-yet-consumed digital content, your statutory withdrawal rights remain unaffected. To exercise a withdrawal where applicable, contact info@upvis.de.

8. Acceptable use

You agree that you will:

• only upload photos that depict you, or for which the depicted adult has given consent, and to which you hold all necessary rights;
• not upload images of minors or any unlawful, infringing or abusive content;
• not impersonate others or misrepresent your identity;
• not attempt to disrupt, reverse engineer, scrape, overload or abuse the Service, and not circumvent usage limits or the credit system.

We may suspend or terminate access for violations or where required to protect the Service, users or third parties.

9. Your content & license

You retain your rights in the photo you upload. You grant us a limited, non-exclusive license to process your photo and inputs solely to provide the Service (including transmission to our processors such as Google for generation). The generated results are provided to you for your personal, non-commercial use.

10. Intellectual property

The Service, including its software, design, brand and content created by us, is protected by intellectual property rights and remains our property or that of our licensors.

11. AI disclaimer

AI-generated images and recommendations may be inaccurate, idealized or not perfectly resemble you, and may not reflect real products or fit. They are inspiration only. You are responsible for your own purchasing and styling decisions.

12. Affiliate links

"Shop the Look" may contain affiliate links; we may earn a commission if you purchase via such links, at no extra cost to you. Purchases are contracts solely between you and the respective third-party retailer, who is responsible for their products, prices and terms.

13. Availability & changes

We strive for high availability but do not guarantee uninterrupted operation. We may modify, suspend or discontinue features, and may impose rate limits or pause generation for operational or cost reasons.

14. Warranty & liability

Statutory warranty rights apply. We are liable without limitation for intent and gross negligence, and for damages arising from injury to life, body or health. For slight negligence we are liable only for breach of a material contractual obligation (cardinal obligation), limited to the foreseeable, typical damage. Any further liability is excluded to the extent permitted by law. Mandatory statutory liability (e.g. under the German Product Liability Act) remains unaffected.

15. Term & deletion

You may stop using the Service and delete your account at any time, which removes your stored results (subject to statutory retention of billing records). We may terminate or restrict accounts for cause.

16. Changes to these Terms

We may amend these Terms where reasonable (e.g. due to changes in the Service or the law). We will make the updated Terms available here; the "last updated" date indicates the current version.

17. Governing law & contact

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of your country of residence remain unaffected. Contact: info@upvis.de.
